His case must now be examined by the German Olympic Committee (DOSB) before Wednesday, the deadline for the list of athletes selected for the Beijing Games to be presented to the International Olympic Committee.
Friedek, 36, appealed to the DIS because he believed he met the selection criteria with two jumps of 17m and 17,04m on June 25.
The German athletics federation had fixed 17m as the requirement for Beijing, to be achieved twice in the three months prior to the Games.
But they refused to include Friedek in their squad because both jumps were achieved during the same competition.
"The judge clearly established that Charles fulfilled the criteria for qualification and there are positive signals coming from the DOSB that he will be selected," said Manuel Grahmann, president of Friedek's club.
Friedek was world champion in 1999 and European runner-up in 2002.
