Flamboyant musician and choreographer Somizi Mhlongo will appeal against his conviction and sentence on Friday for indecent assault.
Mhlongo, 34, pictured, acted with bravado throughout the trial, even wearing gear with the "F....g Criminal" logo. He was, however, unusually not forthcoming yesterday. He hung up on this reporter.
The Randburg magistrate's court found Mhlongo guilty of indecent assault.
He was sentenced to four months imprisonment or a R6000 fine. Half of the sentence was suspended for three years.
Mhlongo looked on in disbelief as magistrate Hombakazi Thwele passed sentence.
The court found that he had fondled Celani Njapha's private parts in his Lonehill home after offering him a lift on Rivonia Road last November.
Njapha, 28, of Diepsloot, was returning from work at a restaurant in Rivonia in the early hours of the morning.
"I found the accused's version of events full of improbabilities," said Thwele.
"If Mhlongo lived five minutes from the main road, why did he not drop Njapha off and go home?"
Thwele also wanted to know how Njapha could connect, put on a porn movie and operate a DVD player in a house he had never been to before.
"The court found the complainant's testimony satisfactory and honest," Thwele said.
In mitigation of sentence, Mhlongo's lawyer, Nyiko Khupane, said he was a first-time offender who made a huge contribution to society.
Mhlongo's application for leave to appeal will be heard on Friday.
