It is impossible to have an HIV-free South African National Defence Force (SANDF), and an army policy discriminating against people with HIV is unconstitutional, the Pretoria high court heard yesterday.

It is impossible to have an HIV-free South African National Defence Force (SANDF), and an army policy discriminating against people with HIV is unconstitutional, the Pretoria high court heard yesterday.

The Aids Law Project, acting on behalf of the South African Security Forces Union and individual members of the SANDF, brought an application before the court to force the SANDF to change its policy of preventing people with HIV from, among others, being deployed externally and promotion. Gilbert Marcus, acting for the applicants, asked the court to declare the blanket exclusion of HIV-positive people unconstitutional. - Sapa
