Suspended SABC chief executive Dali Mpofu has added Minister in the Presidency Azziz Pahad to the list of people he claims are running a smear campaign against him.

Mpofu launched an urgent application in the Johannesburg high court yesterday against his suspension, in which he accused Pahad of instructing the SABC board's chairman and deputy to get rid of him.

"Pahad bears personal animosity towards me because I resisted his unwarranted attempt to interfere during the PSL and SuperSport matters towards the end of 2007," he said.

Mpofu asked the court to lift his suspension, which he said was invalid and unlawful. He also said that the appointment of Gabriel Mampane to his position contravened the law. He said his suspension was unlawful because he was given no notice of the meeting that concluded with his suspension. He was also not given an opportunity to be heard before the decision was taken.

"The decision to suspend was taken arbitrarily in that the real reason for his suspension is not the allegations in the memorandum, but the desire to protect Zikalala," the notice of motion said.

Mpofu said the SABC's articles of association required the board's resolution to be signed by all directors. The SABC argued that the high court did not have jurisdiction over matters of unfair suspension.
