Shot dead during fight over house

Vusumuzi Ndzelu was so furious with the man who had bought his repossessed house that he allegedly killed him.

Ndzelu, 39, and co-accused Mlungisi Mjoli, 23, are standing trial in the Johannesburg high court for the murder in 2006 of Sibusiso Kubheka, a police detective stationed at Honeydew police station.

Stanley Ndlovu, Kubheka's childhood friend who was with him on the night he died, told the court yesterday that the two men had been at loggerheads since Kubheka bought a house in Protea Glen, Soweto, that was repossessed from Ndzelu.

"On the night that he died, Kubheka met me in the street while I was waiting for my girlfriend.

"We started talking and he ended up telling me about a house he had bought and that the previous owner was giving him a problem.

"He told me that he had just been to the house and found the locks had been changed so he could not get in."

He said Kubheka asked him (Ndlovu) to accompany him so that he could help him break the door. Kubheka was also in the company of a woman called Simphiwe Nkomonde and another man.

"When we arrived at the house, we broke down the kitchen door to gain entry. We found two beds inside the bedrooms.

Ndlovu said Kubheka went to a neighbour's house to ask for Ndzelu's phone number so he could ask him why he had changed the locks, only to find that Ndzelu was there.

He said a fight then apparently broke out between the two men. Mjoli then allegedly joined in the fight.

It is alleged that Kubheka then drew his gun but was overpowered. He was shot four times and died outside the neighbour's house.
