Norman Arendse told the Cape Town labour court the department wanted the matter referred to the labour appeal court.
Arendse also challenged the authority of the court to grant interim relief in favour of Theron.
Theron was allowed to return to work at Pollsmoor last year. He had earlier complained about poor working conditions at the prison.
Theron is employed by the Western Cape health department. Correctional Services has refused to allow him to resume his duties at the prison. - Sapa
