A 26-year-old Ekurhuleni woman and her five-month-old baby are living in fear and are in danger of being thrown out of the family's matrimonial home after her abusive customary husband sold the house without informing her.
Cecilia Magauta Motloung of Daveyton Extension 6 yesterday told Sowetan that she has since obtained six restriction orders, including a warrant of arrest, against David Mokhothu, 33, who is the father of her child.
She said police have not acted on her complaints.
But according to Senior Superintendent MT Maupa, Daveyton police station commander, Motloung has also laid intimidation and malicious damage to property charges against the new owner he identified as Aubrey Khumalo and a local estate agent.
Maupa denied Motloung's allegations that the police had failed to arrest her husband after she had obtained several restriction orders against him.
"I can confirm that only four cases against her husband and Khumalo and his estate agent appear in our system," Maupa said.
"Her husband was arrested for common assault in July 2007. The case was later withdrawn for lack of evidence.
"The second, which is a domestic violence case, was committed last month and is set for trial in January next year.
"The third, a malicious damage to property case against Khumalo, was withdrawn when Motloung voluntarily dropped the case.
"The fourth is a case of intimidation and assault on Motloung and her child by both Khumalo and the agent. The case continues."
He also claimed that Motloung's daughter Kgaogelo was injured by one of the four men who had accompanied Khumalo to her home.
They had gone to the house to evict her and allegedly injured the child when she was taken from her bed.
Motloung said: "When I was nine-months pregnant with his child my husband physically abused me by kicking me all over the body and stomach.
"He even denied paternity of the child, saying that he wanted a DNA test to be conducted. But he chickened out when I told him to go ahead with his wild threats.
"The last straw was on November 22 when about five unknown men, among them a man who claimed his name was Khumalo, arrived to evict me from the house.
"While the group threatened me one of them grabbed Kgaogelo from the bed, carried her outside and dropped her on the ground. Because of this she suffered bruises and injured her shoulder."
Sowetan has since learnt that Mokhothu paid R94000 for the house in 2005.
But last month Khumalo bought the same house for R250000.
