Insurance refuses to pay

Thanks for an informative article every week - it's really useful. My question to you is on the insurance payouts for accidents. My brother-in-law used my car recently to drive to Polokwane and had an accident.

After a lot of toing and froing with people from the insurance company, Dial Direct, I was informed that one of the tyres on the car had a thread that was below the accepted minimum and the company refused to pay because the car was essentially unroadworthy.

Is this fair, especially since the so-called bad tyre was not the reason for the accident? - Anonymous
