The National Prosecuting Authority (NPA) could make a decision "within days" over the high-profile case involving the theft of Health Minister Manto Tshabalala-Msimang's medical records.
Spokesman Tlali Tlali said yesterday the NPA, of which the Scorpions are a division, is still studying the docket on the case handed to it by police investigators.
This comes in the wake of increasing speculation that Sunday Times editor Mondli Makhanya and his deputy managing editor Jocelyn Maker are likely to be among those charged. The police have denied their imminent arrest.
"Anything could happen. A decision could happen within days," said Tlali yesterday. The NPA could decide to prosecute or return the docket to the police to "clear up outstanding matters".
Sunday Times lawyer Eric van den Berg said yesterday that the "situation remained unchanged". This refers to an agreement reached with NPA Western Cape chief Rodney de Kock for Makhanya and Maker to present themselves at court at a "convenient time for all concerned". This was part of an email that Van den Berg sent De Kock on Friday. Van den Berg stated that this arrangement would help to "dissipate further negative publicity".
The Sunday Times has insisted that it did not pay for the files.
The newspaper published details of Tshabalala-Msimang's alleged drunken behaviour and abuse of hospital staff during her stay in a Cape Town hospital.
