The Directorate of Public Prosecutions (DPP) in Mmabatho is investigating how a Mpumalanga businessman was granted bail in an attempted murder case despite violating his bail conditions in a separate case.
The DPP has requested the dockets relating to charges against Solly Madileng and will make a decision next week.
Last Wednesday, the Marapyane periodical court postponed Madileng's assault and kidnap case pending the DPP's decision which is expected next Tuesday.
The DPP's intervention follows an outcry from the police and community after Magistrate Isaac Motsoai's decision to grant bail to Madileng, arguing that the decision was tantamount to giving him a licence to kill.
Motsoai of Temba magistrate's court granted Madileng R4000 bail on his attempted murder case.
Police complained that Madileng, who allegedly shot his wife seven times and left her for dead, was already out on R5000 bail for assaulting one of his employees when he allegedly tried to kill his wife, Maki Madileng, 38.
The investigating officer, Jan Phofele, said setting Madileng free would put Maki, who is still in hospital, at risk, but the magistrate said there was no reason to refuse him bail.
It is alleged that Madileng kidnapped and assaulted his former employee, Ephraim Makitla.
He had accused Makitla of stealing from his supermarket after a burglary at his shop.
Madileng suspected Makitla of being behind the burglary.
He laid burglary and theft charges against Makitla, but the case was thrown out of court because of insufficient evidence.
Madileng allegedly took the law into his own hands and kidnapped and assaulted Makitla.
Makitla laid charges of assault and kidnapping against his former employer.
Madileng was arrested and granted bail by the Marapyane periodical court.
"While on bail, he went to see Maki at her parents' home.
"This was after she had moved out of their marital home," investigating officer Phofele told the court.
"He tried to reconcile with his wife, but she declined. He then sprayed her with bullets and left her for dead," Phofele said.
He also told the court that Madileng was a danger to society, and that Maki would be at risk should he be granted bail.
