The National Prosecuting Authority (NPA) wants to have all the documents seized during the raids on Jacob Zuma and his associates to be preserved by the supreme court of appeal for a possible Zuma trial - even if it fails in its current appeal.
The Scorpions are currently engaged in a legal battle - lodged in the Bloemfontein supreme court of appeals - against a court order which declared that its 2005 raids on Zuma and his associates were unlawful.
Advocate Wim Trengrove has argued that if the NPA fails in its appeal, it wants all the evidence seized during the raids preserved by the Registrar of the Court.
Trengrove argued the NPA wants this to be the case so that a trial judge could take a decision on the admissibility of the evidence.
He added that the National Director of Prosecutions would decide whether to charge Zuma and Thint only after the appeal court had determined the status of the evidence seized in August 2005.
