Two years ago, she planned to erect tombstones for her three children and approached Weinstein Memorial Works.

She paid R19000 in seven instalments over two years instead of one, which made her liable for a 20percent penalty.

Though it was clearly stated that Moldenhauer would have to wait six to eight weeks to have the stones erected, she went ahead and invited guests for the unveiling on June 3.

When Weinstein said the stones could not be raised within two weeks, she approached Consumer Line.

But the contract Moldenhauer signed does not allow her to cancel it. It also denies her the right to demand her money back.

Larry Weinstein said Moldenhauer was in breach of the contract and liable for the penalty of R3800.

He refused to release her from her contract or refund her money. He is willing to reduce the penalty by half if Moldenhauer wants the stones erected. Alternatively. she can to reduce the size of the stones, he said.
