Magistrate finally granted leave to appeal

Mxolisi Matereke, a Johannesburg magistrate jailed for murdering his best friend five years ago, has been granted leave to appeal against his conviction and sentence.

This comes after Johannesburg high court judge Neels Claassen yesterday set aside the order he had previously made preventing Matereke from appealing.

Matereke, 46, of Meredale in Johannesburg, is serving a 10-year sentence for killing Vika Ngcobo in August 2002.

After his conviction Matereke brought several unsuccessful applications to appeal against his conviction and sentence.

But yesterday Claassen, in reversing his previous decision, said that at the time he had been unaware of Matereke's applications to other courts and ruled that all Matereke's applications be brought under one court.
