There was mixed reaction yesterday to comments that the Scorpions were acting unconstitutionally.
The A NC's Matthews Phosa said it was unconstitutional not to allow suspects and witnesses to remain silent during questioning.
Phosa said sections of the National Prosecuting Authority Act infringed on rights. Refusal to answer questions can result in imprisonment and a fine.
ID leader Patricia de Lille said Phosa might be right, but the DA's Sheila Camerer said he was wrong.
De Lille said: "People have the right to remain silent. Why is it not applicable to the Scorpions?"
Camererquestioned Phosa's agenda. Incriminating statements made by suspects cannot be used against them in a criminal case.
