A 50-year-old Estcourt magistrate, Hernan Swart, appeared in the Weenen magistrates' court yesterday on a charge of drunken driving.
He was arrested while driving in Colenso on Saturday night.
Police spokesman Vincent Mdunge said patrolling policemen asked him to pull over.
"He was taken to a doctor where blood samples were taken for testing," said Mdunge.
The magistrate was arrested and spent a night in the police cells.
Swart was released on R500 bail the next day.
He has not been asked to plead and the case was postponed to May 10.
