Rape charge against medic fails

A case of rape against a Limpopo hospital superintendent who is also a medical doctor at Malamulele Hospital in Limpopo was struck off the roll in the Malamulele magistrates' court yesterday.

Justice Mulaudzi, 35, was charged with rape after a complaint by a patient.

The case was struck off the court roll after the directorate for public prosecutions studied the case and found there was insufficient evidence.

The doctor was arrested in December.

The 22-year-old patient alleged that she had gone to the doctor's surgery for a check-up when he raped her.

She said immediately after the alleged incident she went to the Malamulele police station to lay a charge of rape.

Mulaudzi's attorney, Antonio Ramano, said he was still studying the ruling of the directorate for public prosecutions. But he made it clear they were going to lay a charge of defamation of character against the complainant.

He said the doctor's image had been tarnished as a result of the woman's allegations.

Phuti Seloba, a spokesman for the Limpopo Department of Health and Social Development, said that his department welcomed the ruling, but he indicated that they were still conducting an internal investigation of misconduct against the doctor.

"The outcome of our internal investigation will determine what course of action to take," he said.
