Janitor denied bail in rape case

"A child's future has been destroyed," a magistrate told Matanzima "Come Ladies" Makholwa, 48, denying him bail yesterday in the Bhisho magistrates' court.

Makholwa, a school janitor, is accused of raping a 10-year-old girl at her home in Zwelitsha, Eastern Cape, on October 25 this year.

The child's uterus was irreparably damaged and had to be removed.

This is allegedly the second time Makholwa has raped the child. The first time was in 1998 when she was two years old.

The magistrate said that he was not implying that Makholwa was guilty, but the evidence that the child had been psychologically affected, that she had lost her uterus and that she was doing badly at school because of the alleged rape "could not be ignored".

"The child will grow up knowing that she will not have children. Surely that will affect her mental state?" he said.

The girl's mother told the court that Makholwa had intimidated her after the first alleged rape and that he had been granted bail by the court. She had then not pursued the case. It was subsequently thrown out of court.

The magistrate said that if the investigating officer in the first case "did not discharge his duties . the mother can sue [the state]".

He advised her to consult an attorney.

The case was postponed to February 2.
