And five years later the newspaper could still not prove this was the true, the public protector Lawrence Mushwana told the court.

The newspaper applied for an order to set aside a 2005 report by the public protector about his investigations into the alleged misappropriation of public funds that allegedly ended up in ANC coffers.

Mushwana said the order should be dismissed. - Sapa
