A lawsuit filed by the family of a woman who died at a hospital after she was moved to make room for superstar Michael Jackson has been thrown out of court.

The family of Manuela Ruiz planned to sue Jackson and the Marian Medical Centre in California for keeping her from critical care on the day Jackson was brought in with flu-like symptoms in 2005.

The lawsuit said Ruiz, 73, was on life-support after a heart attack and was moved from the two-bedroom so Jackson could occupy it.

Judge Rodney Melville ruled he would allow challenges to the complaint filed by attorneys for Jackson and the hospital, who argue the facts of the case did not justify the allegations.

Melville gave the plaintiffs' attorney 30 days to redraft their complaint. - Wenn
