@Mogwapatholo, I think you can shoot when you are threatened, ie you would have established that the intruder/other party is armed and has threatening body language, nothing can justify shooting an unarmed person 4 times even if that person is an intruder but in SA most cases intruders are armed to teeth and almost always threaten the occupants of the property they illegal invade, so I guess we can safely say its safe to shoot an intruder in the body but if you are a woman and you are with kids you better make sure you accurately aim higher than the shoulders cause if the intruder still has some mobility he will overpower you. TupacAmaru, I'm not a lawyer either, but I've done the court and prison thing, so I know a little bit about it.
Case dismissed = The court did not even call in witnesses or anything. Example, the DNA evidence came back and showed very clearly it was not him. Then a judge will dismiss the case.
Not guilty = As in this case, the DNA evidence was comprimised (maybe even on purpose), and it could not be determined who's DNA it was. So, seeing that there is no surety if it was him or not, the case continues to determine if there is any other conclusive evidence against him. I believe this guy was lucky, that's all.

How long does it take him to put them on and locate his pistol and "sneak" to shoot the burglar? Obviously he did not startle the burglar, otherwise he wouldve known it was her... Surely he has an alarm, did it go off?

When one is asleep their brain is not functioning at the same peak as when they are awake.
The colour of majority of burglars does not register when the adrenalin of fear kicks in, it knows no colour. So to apply some logic thinking its people of a different colour that usually commit a certain crime is a bit unfair since we are not aware if the lights were turned on or not at the time of the incidence. He only dated her since November, so what could possibly be his motive in wanting her dead? That has to be established. Mistakes can occur when a reasonable person thinks they are in danger, and also we have to answer why he shot many times, as his life may not have been in danger after the first shot. However I find some comments here degrading to say the least; one does not know the future to laugh at such a sad incidence. It is not really cool.

TupacAmaru, I'm not a lawyer either, but I've done the court and prison thing, so I know a little bit about it.Case dismissed = The court did not even call in witnesses or anything. Example, the DNA evidence came back and showed very clearly it was not him. Then a judge will dismiss the case.
Not guilty = As in this case, the DNA evidence was comprimised (maybe even on purpose), and it could not be determined who's DNA it was. So, seeing that there is no surety if it was him or not, the case continues to determine if there is any other conclusive evidence against him. I believe this guy was lucky, that's all.

So Oskido's girl was havin an affair with Mark Batchelor's friend whom he threatened to "cut off his legs" a couple of weeks/months ago (an affair that allegedly occured during the Olympics)... And she "rocked up" at his home at around 4am this morning to "surprise" him? HA!I dont watch soapies but this would make a brilliant one. Has the security guard (given that its a manned security estate) been interviewed by the police to verify her "arrival" at the security estate? Or security cameras, etc?
Where in the house was the victim shot? When and how did Oskido get there if he was "startled" in his sleep by a burglar? Did he sleep with his blades on? How long does it take him to put them on and locate his pistol and "sneak" to shoot the burglar? Obviously he did not startle the burglar, otherwise he wouldve known it was her... Surely he has an alarm, did it go off?
Look, this story has more leaks than the Nkandlagate saga but the competency of detective work will ultimately determine all these questions and more... I somehow doubt that it will turn out like that though...

When one is asleep their brain is not functioning at the same peak as when they are awake.The colour of majority of burglars does not register when the adrenalin of fear kicks in, it knows no colour. So to apply some logic thinking its people of a different colour that usually commit a certain crime is a bit unfair since we are not aware if the lights were turned on or not at the time of the incidence. He only dated her since November, so what could possibly be his motive in wanting her dead? That has to be established. Mistakes can occur when a reasonable person thinks they are in danger, and also we have to answer why he shot many times, as his life may not have been in danger after the first shot. However I find some comments here degrading to say the least; one does not know the future to laugh at such a sad incidence. It is not really cool.
