A convicted murderer is fighting for his life in hospital after he ate poison minutes before he would have been sentenced in the Johannesburg high court.

Sthembiso Emmanuel Khumalo, who was out on bail during his trial for the grisly murder of Thulani Alfred Myeni, is believed to have brought the poison with him to court on Tuesday.

That morning Khumalo was found guilty of killing Myeni in 2008 by tying him to the rail tracks between the Mpilisweni and Angus train stations in Thokoza, Ekurhuleni.

He then Myeni behind for a train to run over him.

His dismembered body was discovered the following day.

"I do not know what kind of poison it was, but he took it after he was convicted," Myeni's lawyer Thulani Ntunja said.

Khumalo was taken to South Rand Hospital, and later transferred to Charlotte Maxeke Hospital's intensive care unit.

His sentencing was postponed to April 28.
