LAWYERS representing three men accused of conspiring to kill an investigating officer say their clients are facing a wrong charge.

They told the Benoni regional court on Friday that brothers Skhumbuzo and Khulekani Ngobese, and their business partner Alfred Mnisi, could not have committed conspiracy because the police acting as hitmen had no intention of committing the crime.

"It cannot be conspiracy because it was a trap. The other party pretended," argued Marius Wyngaard who represents Mnisi.

The men were allegedly recorded planning to kill the officer in Skhumbuzo's murder case for the shooting of six-year-old Thabitha Mahlangu.
