THE question of whether a Krugersdorp student's fight for promotion to Grade 12 should be heard in court came under scrutiny in the Johannesburg high court yesterday.
Judge van Oosten questioned pupil Edwin Botha's legal representative on why the matter should be heard in court.
He asked if the court had the jurisdiction to replace an internal appeal that should be carried out by the department of education.
Botha took the department to court after it allegedly overturned a decision by his principal at Hoërskool Noordheuwel to promote him to Grade 12 after he did not complete Grade 11 last year.
Botha allegedly dropped out of school in October 2009 following a prefect initiation ceremony that left him traumatised after he was elected deputy head boy.
Van Oosten appeared unhappy with the response of Botha's legal representative to his concern that an internal appeal had not been exhausted before the case was brought to court.- Sapa
