THE application for leave to appeal by Joseph Tefo Khoza was struck off the roll yesterday in the Johannesburg high court.
Judge Mojake Mabesele struck the matter off the roll after Khoza's lawyer Owen Khumalo failed to attend the proceedings.
Prosecutor Deon Barnard told the court that he received a call from Khumalo that he would not be in court.
Barnard said Khumalo told him he would first file the papers before making a formal application.
Khoza, 37, had killed his girlfriend Phelisa Mkhuma, the sister of Pretoria News editor Zingisa Mkhuma on June 15.
