The South African Human Rights Commission (HRC) will represent complainant Simon Manana in court.
HRC spokesperson Vincent Moaga said Manana approached the commission last year to seek redress. He said the commission felt that Manana was discriminated against and his dignity violated.
Manana, 54, said he endured "outrageously racist" treatment from his neighbour, William Renney, at the Dewetshof Retirement Village in Sandton.
Manana, who walks with crutches, has lived in the retirement village since 2006. He said Renney had called him derogatory names.
The complainant said white residents were rude towards him and other black residents. He said Renney would swear without provocation.
He said Renney assaulted him despite his obtaining an order against him from the court.
Renney has denied the allegations against him. He in turn accused Manana of assaulting him. - Namhla Tshisela
