Advocate Maro Papachristoforou spent the whole of yesterday outlining contradictions in the statement Sivhidzho made while applying for bail three years ago and the testimony she delivered in court recently.
"At the end of this trial I'm going to prove that she is lying. There are aspects that I am going to challenge that will prove she is lying," Papachristoforou said after the defence objected to some of her questions.
Sivhidzho was being cross-examined in a trial-within-a-trial. She wants the statement in which she admitted to killing her husband rejected as evidence. She claims to have been tortured and forced by the police into making a confession.
In a detailed statement Sivhidzho made to support her bail application, she explained what happened during and after her arrest, except her alleged torture by the police.
The state is now using that affidavit to try and prove their case that she was never tortured, but had fabricated the claims during the trial.
"You say you were assaulted and tortured terribly by four men, who also pulled a glove up your face. I don't understand how out of all the information you put in your affidavit, you would have just one paragraph about the assault. The paragraph is so scantily done, and for such important information." Papachristoforou said.
Sivhidzho insisted that her then lawyer, Ace Ndou, had misrepresented her. "I gave Ace all the information, I don't know why he did not include it in the affidavit," she said.
Sivhidzho is accused of conspiring with two co-accused, Ntambudzeni Matsenene and Arnold Sello, to murder her husband Avhatakali Netshisaulu.
Netshisaulu was hijacked, assaulted and burnt alive in the boot of his car soon after calling his wife to say he was being followed by two cars.
The trial continues.
