Challenge to RAF Act

SEVEN road accident victims will today ask the Pretoria high court to be joined as co-applicants with the Law Society of South Africa against the Transport minister and the Road Accident Fund.

The Law Society, the South African Association of Personal Injury Lawyers, Quadpara Association of South Africa and National Council for Persons with Physical Disabilities, are challenging the legality and constitutionality of the RAF Amendment Act, which came into effect last August.

The victims were all injured in road accidents after the amendment came into effect. They state in their founding affidavits that the amendments substantially reduced or totally denied them certain rights to compensation that they would have had, had they been injured before the Act came into effect.
