The protector's office said it was "considering legal advise regarding a possible appeal" against the ruling.
"Having studied the judgment in the application brought against the Public Protector by the Mail & Guardian on the Oilgate Report, the Public Protector noted that the basis of the order setting aside the report is the interpretation of the constitutional mandate of the Public Protector," spokesperson Kgalalelo Masibi saidyesterday.
The ruling was pronounced on Thursday by Judge Ntendeya Mavundla on behalf of Judge Ntsikelelo Poswa, who presided on the matter almost two years ago.
The Oilgate scandal came to light in 2005 when the Mail & Guardian was gagged by the court from publishing a story involving the payment of millions of rands between an oil company Glencore, PetroSA and a firm called Imvume. Those millions ended up funding the ANC's 2004 election campaign.
