Makobe has lost a case against the provincial legislature and Ike Kekana, leader of the New Vision Party (NVP).
This was after the UIF redeployed Makobe to replace Kekana as its member in the legislature two years ago.
Kekana had crossed the floor to form his own party ahead of the lapsing of the floor-crossing period.
Kekana then challenged the matter in court and won . The court ruled that the costs of the mater should be borne by Makobe.
As a leader of the opposition Makobe was earning about R700000 a year. He was in the legislature from October 2007 to November 2008. He owes the legislature more than R1 million.
Sowetan is in possession of a copy of a warrant of execution against Makobe.
It was issued in the North Gauteng high court.
"You are hereby directed to attach and take into execution the movable goods of Alpheus Makobe at his home in Glen Cowie and to cause the same to realise by public auction the sum of R51663 together with interest therein at the rate of 15,5 percent per annum from March 9 2009 being for taxed costs and interest and further legal charges of Ike Kekana."
Makobe is alleged to have interdicted Kekana and the legislature after Kekana won the case to return to the legislature.
Kekana told Sowetanyesterday he was looking forward to getting his money as he had suffered enough as a result of the matter.
"I'm happy that the court has decided because I had spent a fortune to fight the case in court," he said.
According to the court papers, Makobe will have to surrender his Toyota Fortuner, which is valued at R398000.
Spokes-person of the provincial legislature Kenny Mathivha said yesterday their legal advisers were still in the process of verifying how much Makobe owed them.
Makobe said he was not aware of such a warrant .
