Police in KwaZulu-Natal say they cannot proceed with criminal charges - including statutory rape - against Makhumbuza High School teachers accused of sex crimes until the victims themselves lay charges.

Teaching resumed at the school in Umlazi, south of Durban, yesterday. The situation at the school was tense and police were monitoring the situation.

Police spokesperson Superintendent Buhle Ngidi said that they are not in a position to prosecute the teachers implicated in the sex scandal. He said they would wait for the parents or victims themselves to press charges.

Meanwhile, suspended KwaZulu-Natal education department workers stand a chance of being reinstated following last minute negotiations between the department of education and teachers' union Sadtu.

Provincial MEC Ina Cronje suspended more than 230 workers comprising administrative workers and cleaners last week after they failed to respond to an ultimatum to return to work.
