The case against 12 people alleged to be behind the multi-million rand airport heist was postponed in the Johannesburg high court yesterday.
Nine of the 12 accused appeared briefly before Judge Antonie Geldenhuys.
Advocate Cronje Kriel, representing Christopher Billings, 35, questioned the admissibility of the state's evidence against his client.
The evidence was obtained from one of Billings' co-accused, who had entered into a plea agreement with the state.
Kriel said the way in which the state had obtained the evidence from Ishmail Nazir, 40, was unconstitutional.
Nazir was convicted and sentenced in October last year after pleading guilty to charges of robbery with aggravating circumstances.
