Ruling demands reinstatement

What is historic about this judgment is that common sense was applied so consistently to contradict the controversial rulings of the supreme court of appeal and constitutional court.

These higher courts failed to appreciate that the procedural injustice dispensed against Zuma was in direct conflict with the Constitution, and the state had no basis to charge him without affording him an opportunity to make representation on the matter.

Former NPA director Bulelani Ngcuka stated publicly that there was no credible evidence to secure a conviction against Zuma. But the state unleashed the Scorpions to limitlessly fish for evidence to prove that a bribe was discussed in a particular meeting with Zuma.

Interestingly, the NPA never asked President Thabo Mbeki under oath to clarify details of his alleged meeting in France with the arms dealer who did not make the short-list, but won the contract.

Now a process must be set in motion to reinstate Zuma as deputy president.
