A warder's plea for intervention at the severely overcrowded Mthatha Medium Prison in the Eastern Cape was rejected by the South African Human Rights Commission.
The Daily Dispatch newspaper claims that SAHRC provincial manager Lufuno Mmbadi said they could not conduct an investigation into conditions at the prison.
The commission said in a letter to a Correctional Services employee that its involvement would be premature and that it was not in a position to investigate until all internal processes had been exhausted.
The Dispatch on Wednesday broke the story about overcrowding in the jail, the worst in the country, with the prison population being more than four times what it should be.
On a photo, sneaked out by prison warders, 300 men are shown crammed into a cell built for 15 and allegedly includes teenagers.
