Ten children are being kept at a place of safety after their foreign mothers were arrested at a refugee camp last week.
Lawyers for Human Rights (LHR) say these children have the same rights as South Africans.
LHR lawyer, Solly Lebelo, said the mothers were among 16 people arrested last week at the Glenanda shelter for victims of xenophobia for allegedly throwing stones at the police.
The accused will appear in the Johannesburg magistrate's court on Wednesday to apply for bail.
According to the LHR, displaced foreign children in need of care must be placed in a place of safety, their personal circumstances investigated by a social worker and a children's court inquiry opened, conducted and finalised. This would apply to the children whose parents were arrested last week.
