Notable as well is the aggressiveness and brutality of these criminal activities.

The state, as the guardian of minor children, passes legislation governing the upbringing, nurturing and protection of children.

There are also global concerns about children in conflict and UN resolutions regarding exploitation, abuse and neglect of children have been adopted and implemented in most countries, including South Africa.

Children should be brought up by the community in which they live. In this way, tried and tested societal norms and values entrenched from an early age lead to good morals becoming a sustainable life-long practice.

Children who commit crimes are not immune from prosecution. In every case, a thorough investigation is instituted. Before a court can convict a child, it has to be determined if the child has criminal capacity. Children under seven are presumed to lack criminal capacity and this presumption cannot be rebutted. Children aged between seven and 14 are also presumed to lack criminal capacity, but the presumption can be rebutted.
