State lags in kidnap case

The state still has to produce the CCTV camera footage and an audio-tape in the kidnap case against Hilda Tumi Gumbi to prove she kidnapped a baby.

The case is being heard in the Johannesburg magistrate's court.

Gumbi, 22, of Soweto, is accused of stealing the baby of an unsuspecting Tembisa, Ekurhuleni, teenage mother last October 11.

She briefly appeared in court on Friday and the case was postponed to February 15.

Defence lawyer Fortune Mashamba said the state claimed to have an audio-tape and TV footage as crucial evidence but that these have not been put before the court.

"We have to view the tapes to see whether there had been a conversation between my client and the baby's mother," Mashamba said.

He said it rested with the court to collect evidence to prove that the baby was kidnapped.

During bail application Gumbi indicated to court that her defence would be that she was a friend of the mother of the baby and that there had been an agreement between them that she would raise the baby.

Gumbi is said to have lured baby Kgotsofatso's mother, Pretty Mahlaela, to the Johannesburg city centre where she allegedly snatched the nine-day-old baby from Mahlaela and disappeared.
