Files for divorce behind her back

A 43-year-old Ekurhuleni banking consultant has landed in the street after her husband, a Johannesburg magistrate, kicked her out of their home this week.

Tebatso Musi None told Sowetan yesterday that her husband, Mokgethi None, obtained a divorce decree without her knowledge.

And to compound matters, he has obtained a protection order against her.

The high-profile couple had been married for 16 months.

The woman was still reeling from the shock after police arrived to serve her with the protection order, when her husband produced the divorce decree dated August 24.

Mrs None, who has also filed for divorce, was still waiting for it to be finalised when her husband beat her to it.

"I did not know that he had already divorced me. I only learnt about it on November 15, the day after he had badly assaulted me," she said.

After she was ejected from their house, Mrs None sought refuge with her helper and spent the night in a rented backroom a stone's throw from her home.

She said police had warned her not to return to her house when they evicted her.

Wearing black tights, a white long-sleeved vest and a purple night dress, tears rolled down her face as she related her story.

She claimed that the protection order was processed by her husband's friend, a lawyer.

The order prohibits her from going near her husband, their house or his workplace.

"He thinks that because he is a magistrate he can do as he wants. He should be enforcing the law and not breaking it," Mrs None said.

She also said her husband was abusive.

Mr None has also made similar claims against his wife.

The two do not have any children together. They met in August 2001 and were married in June last year.

They both have children from previous relationships. Mrs None has a 15-year-old daughter and her husband a 10-year-old son.

In the protection order the man states: "This woman and I are divorced. She abused me physically, mentally, emotionally and psychologically.

"She abuses me in front of my son and that affects him psychologically."

He also said that Mrs None used vulgar language and would sometimes insult him in front of neighbours.

"She doesn't want me to move on and does not want to consent to the divorce because she wants attention.

"She has caused me so much frustration," said Mr None.
