M&G wants court to rule on Oilgate

The Mail & Guardian newspaper has asked the Pretoria high court to force the public protector to re-investigate the alleged misappropriation of public funds by PetroSA in the Oilgate scandal.

The Mail & Guardian newspaper has asked the Pretoria high court to force the public protector to re-investigate the alleged misappropriation of public funds by PetroSA in the Oilgate scandal.

The newspaper applied for an order to set aside a report by the public protector in July 2005 in which it declined to investigate complaints and exonerated the persons alleged to have misappropriated or abused state funds or public power.

The report said "much of what has been stated was factually incorrect, based on incomplete information and was unjustified speculation".

The articles investigated an alleged R11million donation made by Imvume Management to the ANC before the 2004 elections. The writers claimed there was a plan for the ANC to support Imvume in obtaining lucrative Iraqi oil contracts, the profits from which would be used to fund the ANC.

The newspaper contended that the public protector had not carried out its constitutional duties. - Sapa
