Jeffery Hurwitz, director of Zalatex, the black empowerment company established by Latex Surgical Products, appeared in the Pretoria commercial crimes court on Friday.
Hurwitz, 51, accompanied by his lawyers, handed himself over to the Pretoria Commercial Crimes Units.
Together with his co-accused Sajeev Joseph, Hurwitz is facing corruption and fraud charges. They are out on R10000 bail each.
Hurwitz is the third person to be arrested after Sowetan exposed a condom bribery scandal last week.
Another suspect, a South African Bureau of Standards testing manager, Sphiwe Fikizolo faces corruption and fraud charges for allegedly certifying defective condoms for cash. He appeared in court on Thursday and was granted R2000 bail.
The scam resulted in condoms that failed quality testing being passed on to the public.
The investigation has so far revealed more than 6,3million defective condoms may have been released to the public as a result of the scam, putting millions of people at risk of contracting HIV.
Last week the Department of Health recalled more than 4,6million condoms from warehouses and health facilities.
The company has a three-year contract with the department through its black empowerment wing, Zalatex, to produce Choice condoms that are distributed free of charge to the public. It was expected to supply more than 38million condoms by the end of the contract.
Health Minister Manto Tshabalala-Msimang is expected to announce if the company will face further sanctions.
Hurwitz, Joseph and Fikizolo's cases were postponed for October 10 for further investigation.
