The Gauteng health department is to launch an inquiry into the non-payment of R317000 in compensation to a patient disabled while being treated in hospital.
A spokesman for the department, Zanele Mngadi, said yesterday that Dingaan Nyathi was disabled in 2002 because of negligence at the Kalafong and Pretoria academic hospitals in Pretoria.
"The department paid the money to Nyathi's lawyers on May 4," said Mngadi.
Nyathi obtained a default judgment in the Pretoria high court in November. The department was ordered to pay his medical and legal expenses.
But the department failed to make the payment.
The matter was referred to the constitutional court, which also ordered that Nyathi's expenses be paid.
Mngadi said the inquiry would be led by an independent lawyer and would look at all aspects of the department's conduct in the case, including the possibility of neglect, failure to perform duties and unprofessional conduct. - Sapa
