Freddy Ratlala Mashimo, 37, told the court he and his wife, Madintwa Helen Mashimo, were struggling with each other over the control of a firearm on March 29 2005, when it accidentally went off.
The state alleges Mashimo shot his wife after they had an argument over a restraining order served on him.
She died as a result of gunshot wound to the head.
The case was postponed until today when the trial continues. Mashimo's bail of R3500 was extended. - Sapa
