Second wife takes control of Jabu Khanyile's estate

Jabu Khanyile's first wife, Nomasonto Daphney Khanyile, 49, yesterday lost the battle for control of her late husband's estate.

The only people who supported her were her two children by Khanyile, Bongani and Duduzile.

Wife number two, Khululiwe Gloria Sithole, 38, was supported by three women, all mothers to Khanyile's children.

She also received one vote from a child Khanyile had informally adopted.

The assistant master of the high court, Leonard Pule, ruled in favour of Sithole, declaring her the only legal wife of the late Afro-Jazz star.

In proceedings which were held privately in the offices of the master of the high court at 66 Marshall Street in Johannesburg, Sithole nominated her attorney Kobus Boshoff as executor of the estate.

The ruling ended the dispute over the estate of the late Khanyile by his wives since his death in November last year.

But Daphney has 14 days to ask for a review of the ruling by the high court.

It is not known how much the estate is worth, but it is believed to be several millions of rands.

It includes an undisclosed sum from his record company, two houses worth jmore than R2million and three luxury cars.

Daphney filed an urgent application in the Johannesburg high court on December 15 last year in a bid to stop Sithole from using money accrued from Khanyile's estate.

She claimed Sithole had unlawfully tried to have herself appointed as executrix of the estate.

But on January 16, Sithole filed her answering affidavit in which she revealed that Khanyile had divorced Daphney in 2004.

Daphney later filed a responding affidavit in which she claimed she was not aware of the divorce.

The two women, their legal representatives, Khanyile's children, and three women who are mothers of Khanyile's children attended yesterday's meeting.

They nominated the person they believed should be executor.

"The surviving spouse or the person he or she nominates on their behalf is the first preference when an executor is appointed," Pule said when he delivered his judgement yesterday.

He accepted Boshoff as executor of the estate.
