A sacked clerk at an Mpumalanga college, who took her boss to the CCMA last week alleging unfair dismissal, has been reinstated.
Hlobisile Maziya, 24, an intern human resources clerk at the Ehlanzeni College for Further Education and Training in Nelspruit, was reinstated by the college following a ruling yesterday afternoon by the Commission for Conciliation, Mediation and Arbitration.
The hearing was attended by education department representatives and Maziya.
Maziya was fired on February 14, allegedly after refusing her boss' sexual advances. She took the matter to the CCMA, and won.
Maziya of KaMagugu outside Nelspruit signed an 18-month contract with the college in February last year. It was due to expire in October.
But she was fired after Pat Zwane, college CEO, accused her of "incapacity".
At the time, Maziya said she had not been warned and was not asked to appear at a disciplinary hearing.
She said before dismissing her, Zwane had said her performance was unsatisfactory and accused her of undermining the college's managers.
Commissioner Richard Byrne, who presided, said Maziya's dismissal was unfair and ordered that she be reinstated. He said she should resume her duties on March 26.
Before the ruling, Byrne held up a copy of Sowetan in which she had claimed that she was fired for rejecting Zwane's sexual advances.
"This is a very serious accusation," he said. "How long had Zwane been propositioning you?"
Maziya replied the harassment had been going on since June, but had only taken it seriously when he fired her.
Zwane said he would study the CCMA outcome before commenting.
