Costly consultant sues municipality

The legal wrangle between Limpopo's Greater Tubatse Municipality and Ziyaphenduka Promotions is heating up.

The municipality has rejected claims that it would be bankrupted if Ziyaphenduka's chief executive, Bruce Kgapane, pictured, succeeds in suing it for breach of contract.

Kgapane has instructed his lawyers to sue the municipality for R15million for cancelling a three-year contract.

Ziyaphenduka was contracted by the municipality to boost its image for R900000.

Kgapane had served one year of the three-year contract when the municipality cancelled it.

Mayor Sam Mamekoa said yesterday that the municipality had examined the contract and found that Kgapane had failed to meet some of its obligations.

He said the municipality had hired Kgapane for marketing, promotion, communication and fund-raising services, but his company had not raised any money for Greater Tubatse.

"We are going to defend any lawsuit that the service provider intends pursuing.

"Any litigation emanating from this matter will be vigorously defended," he said.

Mamekoa said: "We are determined to protect all state resources from service providers who intend procuring contracts from the government.

"We will also deal harshly with any official found colluding with any service provider to the detriment of our community."

Yesterday Kgapane said he was going ahead with the lawsuit. He would not say how he arrived at the R15million figure he was suing Greater Tubatse for.
