Jabu Khanyile's former wife failed to file a responding affidavit against her ex-husband's widow in the Johannesburg high court yesterday.
Nomasonto Daphney Khanyile, 49, was supposed to have filed an affidavit yesterday in response to that filed by Khululiwe Gloria Sithole, 38, who had previously answered Khanyile's urgent application last week.
The two began a legal battle over the late musician's estate last month when Khanyile filed an urgent application to stop Sithole spending money from Jabu's estate and to stop her being appointed as executrix of his estate.
She also demanded that Sithole account for all monies withdrawn from Jabu's bank account before his death.
In her answering affidavit, Sithole said she had not done anything illegal and attached a copy of a divorce decree that stated that Jabu was divorced from his first wife on January 26 2004.
An independent attorney told Sowetan that when an answering affidavit had been filed, the applicant, in this case Khanyile, had 10 days in which to respond and that if she did not do so the other party could ask for a court hearing.
