Two popular radio personalities appeared briefly in the Durban magistrates' court yesterday.

Radio DJ Alex Mthiyane was charged with assault and resisting arrest outside his mansion in Durban North at the weekend.

His news editor and colleague, Sthembiso Shangase, was charged with impersonating a policeofficer. He filmed the alleged assault.

The trial of Mthiyane, head of news and host of the Alex and the Crew programme on Igagasi 99.5 FM in Durban, and of Shangase was postponed to February 9.

The pair describe the scuffle that led to their arrest as "racist".

They have laid counter charges of assault against the police.

"I strongly believe this issue has elements of racism," Shangase said.

The duo's lawyer, Nathi Shozi, said yesterday that they would be making representations to the senior public prosecutor to have the charges against them withdrawn.

"We will be submitting our statements before February 9. We believe there's no case against my clients," said Shozi.

Shangase was visiting Mthiyane when a fight broke out between him and a plainclothes policeman .

Mthiyane caught the action on his video camera - but the police erased the footage after calling in five police vehicles as backup.

They arrested Mthiyane for filming the commotion and charged Shangase as well.
