State could push for trial after woman in k-word case misses deadline to file papers

A plea agreement and a psychologist’s report Vicky Momberg undertook to file are a “pie in the sky”‚ the state said on Tuesday.

Momberg‚ the woman whose k-word tirade directed at black law enforcement officers was caught on a cellphone recording‚ had indicated that she wants to plead guilty to the charges she is facing.

 Her lawyer‚ Nardus Grove‚ has not made these documents available to the state since he indicated his client’s intention to the Randburg Magistrate’s court in September.

The parties then agreed for the matter to be postponed to Tuesday‚ and for the defence to file the plea agreement and the expert’s report on October 10.

Grove was absent in court on Monday and Valencia Mathebula appeared on his behalf. Mathebula asked for another postponement for the documents to be handed to the state.

A visibly upset state prosecutor‚ Yusuf Baba‚ asked the court to postpone the matter for the last time‚ failing which a trial date be arranged.

“The state submits that the court makes an order for a final postponement and for a trial date be arranged if defence fails to submit the documents‚” Baba said.

“This report is a pie in the sky. I haven’t seen the statement and the report. If I have something in my hand‚ I will deal with it‚” Baba added.

The court postponed the case to October 27.

It is the state’s case that‚ on February 3‚ Momberg called 10111 and “without any provocation” insulted a police officer by calling him a “f****** k*****.

Momberg is also alleged to have insulted two more police officers on the same day she called 10111. She allegedly called a policewoman a “f****** b****” and a male officer “useless and stupid” as well as using the k-word. – TMG Digital
