DA demands answers on Motsoeneng’s status at the SABC

The Democratic Alliance (DA) has given the South African Broadcasting Corporation (SABC) until Monday to tell it what position Hlaudi Motsoeneng now occupies and when he was appointed to it.

This‚ the party’s James Selfe said on Thursday‚ follows “the Supreme Court of Appeal’s (SCA) rejection of his frivolous petitions for leave to appeal” a high court ruling that set aside his appointment as the broadcaster’s chief operating officer (COO).

Motsoeneng to report for duty not as COO‚ up to board to decide his fate: lawyer

The DA’s call came on the same morning The Times reported that the SABC board is considering a highly controversial proposal that could lead to Motsoeneng making a comeback as COO.

The newspaper has obtained a copy of a draft resolution sent to board members on Monday for their approval. The resolution is to the effect that Communications Minister Faith Muthambi would be asked to reappoint Motsoeneng as acting COO.

Selfe said the DA’s legal team “has written to the SABC’ and “requested confirmation that”:

- “Motsoeneng currently occupies another position‚ the relevant details of that position‚ and when he was appointed to that position;

- “Another person has been appointed to act as COO‚ and the name of that person; and

- “The SABC has started a legitimate process to appoint a permanent COO that is consistent with the Broadcasting Act‚ its Articles of Association and the Board Charter.”

Selfe said “Motsoeneng and the SABC must now comply with the judgment of the Western Cape High Court”‚ and “failure to do so will leave the DA with no other option but to pursue the matter further”.

Motsoeneng’s lawyer Zola Majavu said‚ after the SCA’s dismissal’s of his client’s appeal‚ that he had advised Motsoeneng that “there would be little point in persisting with the case to the Constitutional Court. He has accepted my view on that score“.

Majavu said it was up to the SABC as to what the future held for Motsoeneng: “Let the employer indicate what are they going to do with your continued employment there.”
