Zuma must personally pay back the money: ConCourt

The National Treasury should determine a reasonable amount to be personally paid back by President Jacob Zuma on the non-security upgrades at his Nkandla homestead.

Zuma must pay back the money spent by the state on non-security upgrades at his Nkandla residence within 105 days.

The Constitutional Court made this order on Thursday after confirming that the remedial action taken against Zuma by public protector Thuli Madonsela was binding.

"The National Treasury must determine a reasonable percentage of the cost of those measures which opt to be paid personally by the president," said Chief Justice Mogoeng Mogoeng.

Mogoeng said that the National Treasury must determine the reasonable costs of the measures implemented by the Department of Public Works at the President's Nkandla homestead that do not relate to security. He said that those costs relate to the visitor's centre, the amphitheatre, the cattle kraal, the chicken run and the swimming pool.

He said Zuma’s failure to comply with Madonsela’s remedial action was inconsistent with the constitution and invalid.

The treasury must report back to the court on this cost in 60 days and Zuma must “personally pay back” the money within 45 days following that report.

Mogoeng also said the National Assembly acted inconsistent with constitution when it absolved Zuma from complying with Madonsela’s remedial action. That decision was invalid‚ the court said‚ and set it aside.
