Fabrication claims against girl accusing alleged child rapist

A lawyer representing the man who allegedly raped more than 20 children in Tembisa and Olifantsfontein on Wednesday accused one of his alleged kidnap victims of making things up.

Peter Dashboy Khoza is on trial in the Johannesburg High Court‚ sitting at the Palm Ridge Magistrate’s Court‚ southeast‚ of Johannesburg.

He faces 152 charges‚ including 46 of kidnapping‚ 29 of rape‚ 28 of assault with the intent to do grievous bodily harm‚ 19 of compelling or causing a child to witness a sexual assault‚ six of theft and one of attempted rape.

Khoza has pleaded not guilty to all charges.

Khoza allegedly committed the offences between 2007 and 2011‚ mainly in Tembisa and Olifantsfontein‚ and targeted girls as young as nine years old.

Khoza’s lawyer‚ Livingstone Nkuna‚ on Wednesday grilled a girl who allegedly saw Khoza rape her sister about why certain aspects of her evidence were not contained in her earlier statement to the police.

The girl from Phalaborwa in Limpopo‚ who started testifying on Tuesday‚ told the court that she and her sister were selling tomatoes on the side of the road on June 6 2007 when Khoza came and told them he wanted to buy some. She was 10 years old and her sister was 11.

She said Khoza told them to go with him to buy spinach from another street vendor so he could give them their money.

She said he led them to a bushy area where he choked them simultaneously before ordering her to lie down and face the opposite direction while he raped her sister.

Nkuna asked her why she had not mentioned in her statement that Khoza asked them to go with them.

The girl‚ whose identity is protected as the alleged victim of a sexual crime‚ said she had told the police.

“The story about the change and [spinach] is an after-thought. If it wasn’t‚ it would have been in your statement‚” Nkuna said.

“This is the most important aspect and it could not have been ommitted by the police‚” he said.

The girl also told the court that Khoza threatened her and her sister with a knife but Nkuna said this was also not in her statement.

“I put it to you that the evidence about the knife is a fabrication‚” Nkuna said.

He said Khoza would testify that he was not in Limpopo when the incident happened.

The trial continues.
